Mohan Singh was a Muslim, rules Malaysian court

Malaysia's civil high court Monday ruled that deceased art director Mohan Singh had converted to Islam, rejecting a plea of his family that his body be released for funeral rites as per Sikh faith.

Judge Rosnaini Saub ruled that due to the religious conversion certificate, the case falls under the jurisdiction of the Syariah court that ruled Mohan Singh died a Muslim June 4, NST Online, the The New Straits Times said on its website.

The court left it to the Syariah Court that deals with issues under Islamic law to determine if he was still a Muslim at the time of his death May 25.

Claims of conversion to Islam by Muslim bodies, upheld by various courts is a sensitive issue among non-Muslims in Muslim majority Malaysia.

Several disputes have arisen in the recent years, one of them being of a Tamil Hindu soldier whose family fought without success to secure his body for Hindu last rites.

The Syariah high court had June 4 ruled that Mohan Singh was a Muslim when he died and should be buried according to Muslim rites.

Syariah high court judge Justice Mohamad Khalid Shaee ruled that Mohan Singh's conversion was valid after hearing testimony from five witnesses and examining the documents brought before the court, Star Online, the website of The Star newspaper said.

He issued the order in chambers, allowing the application by the Selangor state Islamic Religious Council (Mais) to handle the funeral of the dead man.

Mais filed the application with the Syariah high court to certify Mohan Singh's conversion status. He was also known as Mohammad Hazzerry Shah Mohan Abdullah.

Mais claimed Singh had converted to Islam in 1992 in Penang.

However, the deceased's family claimed that the 41-year-old who died of a heart attack, had neither converted to nor practised Islam.

Singh practiced Sikhism and had performed the last rites for his late mother three years ago as per that faith, his family said.

His family filed for a judicial review here against the Sungai Buloh Hospital's decision not to release the body to them to be cremated according to Sikh rites.

There are 100,000 Sikhs in Malaysia's Indian community of an estimated two million-plus.

On Religion and Government

Malaysia is one of the countries that has so many events in the Guiness Book of Records.It is one of a few contries where the government picks the religion for the citizen-once it has done so, the recepiient of the religion has no choice but to pary to this God.How strange-what happened to Freedom of Religion-I supposose it does not exist in Malaysia.

sikhism and Islam

Relatives share the blood and flesh with the person who has passed away.
Religious rituals are only beliefs associated with the living.
What is left behind when the a person dies are the relatives and the person’s contributions to the world. It is so important that the loved ones (family) have the ultimate say over the physical body that they share.
Doing the right thing and being compasionate brings credibility to your religion; imposing on the people does not bring credibility to the religion.
Look at Hindu India, people of all religious faiths who have faced persecution from from their countrise, have fled to seek refuge in India where they are free to practise their faiths freely.

Respect the court decision

Dear all,

I understand the different sentiments here. But mind you, why can’t we respect the court decision? What the judges decided was based on evidence and 5 witnesses' testimony. No questions about that ya.

Strange but true, for all the chaos concerning conversions of Muslims into other religions, have we heard of Muslims fighting for the carcass of the converted all the way to the court and henceforth, leading the nation to further disunity?

As grown-ups, we are supposed to think maturely and let our younger generations have a fairer conception on the whole situation, so as not to be deceived by the unnecessary ruckus.

Going forward, if you are a disciple of on particular religion, go tell your fellow disciples to be very pious so they would not convert into other religions, particularly Islam, and these sorts of problems would not arise.

One should wonder why people are so afraid if their family members or relatives convert into Islam even though it’s the converts' choice. No one can stop them from choosing their own path of belief; well of course we’ll feel hard done by if our fellow disciples’s conversion are planned using dirty tactics as was in the case of Lina Joy where her husbands had targeted her for quite some times before knocking her car from the back and pretended to be very helpful when she was needing it at the hospital she was admitted to.

For the sake of the whole nation in these trying times, maturity is very crucial. Don’t let ourselves be overcome by emotions.

Our domestic law re freedom of religion still applies. So if the dead left courtworthy evidence to prove his conversion, and the court decides based on those evidence, please respect the court.

Mohan singh is sick, not for converting to Islam , but for not having the balls to tell his family. A hipocrite, practise as a sikh and convert to Islam. He does not deserve a place in heaven.
Any way the family shd not brood, say good riddance to this manmokh, a person who leaves the believe of his birth deserve no place in the sikh kingdom hereafter.

Well, this guy is already dead and he could’t say if he wants to be buried in the muslim or the sikh style. Why not let his family decide? Have some compassions and loving kindness for his family. By the way, some people are very ignorant and they just don’t care. Bless you Mr Singh!
